Illegal immigrant pizza worker’s deportation temporarily blocked by judge’s ruling

A federal judge on Sunday temporarily blocked the deportation of the New York City pizza shop worker in order to his native Ecuador after this individual was arrested while making a shipping to a Brooklyn Army base.

Lawyers for the Legal Aid Society acquired the temporary stay for Pablo Villavicencio, 35, after a hearing within Manhattan federal court.

The married dad of two young girls was caught June 1 while making a shipping to the garrison in Fort Hamilton. A routine background check uncovered there was a warrant for their arrest for immigration law infractions.

Federal government Judge Alison Nathan granted the particular stay until July 20. Villavicencio will remain in Immigration and Traditions Enforcement custody in New Jersey till his case goes to court.

In a notice to the ICE office in Nyc, New York Gov. Andrew Cuomo stated Villavicencio’s “expedited removal serves simply no legitimate public safety purpose as well as the circumstances leading to his arrest plus detention raise serious legal plus policy concerns. ”

When he arrived at Fort Hamilton, guards requested identification and he created a city identification card. The background check showed that Villavicencio had been ordered to leave the us in 2010, but stayed.

Redmond Haskins, the spokesman for the Legal Aid Culture, a not-for-profit organization, said lawyers worked through the night preparing the crisis stay request that was argued within court on Saturday afternoon.
